In 2018, Local Laws 55 and 61 changed the way in which buildings are required to approach mold.
The laws establish certain mold and pest related inspections and record keeping requirements, and define new procedures for how to address and discharge mold violations.
Class B and C Mold violations require the involvements of a New York State Licensed Mold Assessor and a separate New York State Licensed Mold Remediation Contractor.
Local Law 55 applies to multiple dwellings with three or more units, as well as one- or two-family homes if the owner does not live on-site. This means building owners must take on the task of addressing indoor mold growth and moisture issues. These responsibilities are not only challenging to manage but are also common culprits behind poor indoor air quality and tenant complaints.
Failing to address mold or moisture problems can result in costly HPD violations, significant fines, and even lawsuits. Tenants have the right to file complaints with HPD or take legal action if these issues are not resolved properly, creating additional headaches for property owners.
In New York City, mold violations issued by the Department of Housing Preservation and Development (HPD) are categorized as either Class B (hazardous) or Class C (immediately hazardous). These violations are part of HPD's enforcement of Local Law 55 of 2018 and other regulations concerning indoor allergen hazards.
For Class B mold violations, property owners face a 30-day deadline to address the issue, which includes not only fixing the problem but also navigating a mountain of paperwork and tenant communication. You must notify tenants in writing about the remediation plan and its completion, then submit a Certification of Correction to HPD to prove compliance—all within the strict timeline.
Class C mold violations are even more demanding, with property owners required to correct the issue within just 21 days. For larger mold infestations over 10 square feet, the law mandates hiring licensed mold assessors and remediators, adding complexity and cost to the process. Once remediation is complete, a licensed assessor must confirm the work was done properly and the area is safe. To close the loop, you must submit a Certification of Correction to HPD on time, or risk escalating penalties.
